TERMS AND CONDITIONS

legal documents: the tenant must present original driver's license and/or passport, original driver's license which must be reviewed by the lessor to verify its legality, the tenant is obliged to provide a photocopy of the driver's license and/or passport and a photocopy of the driver's license certifying that he/she is over 18 years of age.

1.MOTORCYCLE CUSTODY

the lessee undertakes to carry the necessary and obligatory documents and instruments of the motorcycle during the stipulated duration of the present contract, the lessee becomes the guardian for all legal purposes of the motorcycle. only the lessee, signatory of the contract, is allowed to drive the motorcycle, and the lessee agrees to personally drive the motorcycle. the lessee assumes all risk and in the case of allowing other persons to drive the motorcycle, in the act of delivery the lessor motorental col eje cafetero will explain the operation of the motorcycle, and will respond to all doubts and questions made by the lessee about its operation, the lessee by signing this contract certifies to understand perfectly the operation of the motorcycle rented in this contract.

2. MOTORCYCLE TRAFFIC

the lessee is authorized exclusively to circulate and/or drive the motorcycle within colombia. the lessee is solely responsible for the circulation and/or driving of the motorcycle, as well as its correct use and routine maintenance.

3. DRIVER'S OBLIGATIONS

the lessee understands that there are risks related to the fact of driving a motorcycle, good health and physical conditions are required to do so, for such reason the use of narcotics or any other substance that may affect his ability to drive the motorcycle. the lessee, as the sole driver of the motorcycle, agrees to comply with all laws, regulations, ordinances or rules of the colombian transit authority, and especially the specific regulations related to the use and driving of the motorcycle. the lessee also agrees to monitor the levels of oil, hydraulic fluids, coolant and tire pressure as indicated by the lessor. while driving the motorcycle, the lessee must wear a helmet and a vest, and if he/she is carrying a passenger, he/she must wear a helmet and a vest. a male passenger cannot be carried (in the city of pereira), three persons are not allowed on the motorcycle, a person under 12 years of age cannot go as a passenger. you must drive 24 hours a day with your lights on, you may not use the motorcycle to perform any other functions.

if the motorcycle represented in this contract is used for criminal acts, it is certified that it is under the custody, possession and handling of the lessee subscribed to this contract, making the lessee the sole responsible party. in case of need of roadside assistance, the lessee must immediately inform the lessor motorental col eje cafetero, the lessee shall reimburse the lessor motorental col eje cafetero the payment of penalties and / or fines, comparendos resulting from traffic violations imposed during the contract period, the lessee must pay the costs in case of detention of the motorcycle by accident and / or traffic violation the cost of crane, the lessee must pay the corresponding indemnification to the lessor for loss of rentals during the days in which the motorcycle is detained and/or disabled for repairs and others. the lessee is obliged to inform the lessor motorental col eje cafetero within 24 hours of any news that may be notified by the competent authorities of colombia. in case of non-compliance in the timely submission of this information, the lessee will be responsible for any expenses and/or damages suffered by the lessor motorental col eje cafetero directly or indirectly caused by the lack of timely information. in the case of penalties and / or fines must be notified by the lessee to the lessor motorental col eje cafetero immediately, the lessor motorental col eje cafetero is authorized from now on to take without prior notice the corresponding figure of the total and / or partial damage, penalty or traffic violation with all the expenses that this generates, total and / or partial theft of the motorcycle, damage to third parties and others that generates, from the credit card of the lessee. the lessee agrees to maintain the motorcycle with the corresponding security lock.

4. CONDITIONS OF USE

the lessee acknowledges that it has no legal right over the rented motorcycle and accessories provided and therefore has no authority whatsoever and is strictly prohibited from sub-renting the motorcycle to a third party in any form whatsoever. furthermore, the lessee may not under any circumstances use or allow the motorcycle to be used: (a)for the transportation of persons and/or goods for commercial purposes; (b)to push towing vehicles, trailers or other things; (c) racing practices,contests, professional competitions, races on circuits, equipped facilities or roads open to the public; (d) under the influence of alcohol, drugs, or any other narcotic substance capable of endangering the state of consciousness and vigilance thus risking his own life and that of third parties, or the ability to react; (e) in violation of customs regulations, and referring to the circulation and other laws, to enter restricted areas or areas of access or service areas of ports and airports with limited traffic, of person. the data has been provided to the lessor moto motorental col eje cafetero and/or infor-

(f) for purposes contrary to the law. in addition, the lessee assumes the obligation to: (a) conduct, the motorcycle and keep it personally, together with the accessories supplied, with the utmost care and in compliance with all rules of law; (b) ensure the operation and safety of the motorcycle during the rental period, exonerates from any liability to the lessor motorental col eje cafetero hold harmless from any claim by third parties for damages for goods transported on the motorcycle rented or due to a failure or inconvenience to the motorcycle; (d) reimburse the lessor motorental col eje cafetero, upon presentation of the invoice, for all expenses, including legal ones, which would be incurred to obtain the fulfillment of the obligations fines for any reason and / or reason whatsoever, for such purpose therein including those for unpaid tolls, in mechanical guarantee if by mechanical causes the motorcycle could not finish the term of lease, the lessee understands that the reason of the breakdown has been for causes beyond the will of the lessor motorental col eje cafetero without acting in bad faith, for what the lessor will only be responsible to reimburse the value of the rental not enjoyed.in any case the lessor may replace the damaged motorcycle with another, paying or charging the lessee the value of the difference of the rental according to the model, accepting the lessee's waiver of any other type of claim or demand. if the motorcycle is immobilized due to mechanical breakdown, the lessee must immediately inform the lessor motorental col eje cafetero.

5. REGULATIONS OF THE ROAD LAW OF COLOMBIA

the lessee declares to have knowledge of the existing code of road rules. in any case, motorental col eje cafetero must inform the renter about the main rules, with particular reference to the legislative helmet standards, speed limits and the consequences of non-compliance.

6.MOTORCYCLE COVERAGE

the lessor motorental col eje cafetero gives the lessee the option to obtain an insurance against total theft, which has a value per day of 30% of the rental value of the rented motorcycle, this insurance covers in case of theft and/or total theft 70% of the assigned value of the motorcycle in the contract, it covers the corresponding indemnification, the lessee when taking this insurance will only pay for the theft and/or total theft of the motorcycle 30% of the assigned value in the motorcycle contract. but if the lessee does not decide to take this insurance and the rented motorcycle is stolen in its totality and/or partial the lessee must pay the lessor 100% of the value assigned in the contract of the motorcycle, must pay the expenses of denunciation and others that this generates, the rented motorcycle is covered by an insurance of responsibility soat, but it does not cover the damages caused to third parties, in case of accident the lessee must inform immediately to the lessor, the medical expenses that arise for the lessee and/or third parties will be covered by the insurance that has the soat motorcycle according to its policies, the physical damages caused to the motorcycle will be assumed by the lessee in its totality, such as repairs, towing, yards, detention and an indemnity that must be paid to the lessor motorental col eje cafetero for a value of 100% for each day of lost rental and/or inactivity of the motorcycle.for each day that the motorcycle is out of service.

in case of theft or fire, the lessee must inform the competent authorities and to deliver the corresponding information to the lessor motorental col eje cafetero in no more than 24 hours. the original report must be delivered. in case the lessee loses the keys, he/she is obliged to pay a fine of 100.000 cop (twelve thousand colombian pesos).

7. RETURN OF THE MOTORCYCLE

the date, place and time of delivery of the motorcycle have been agreed between the parties before the beginning of the rental, and the lessee agrees to respect what has been agreed upon. any variation must be agreed in writing with the lessor motorental col eje cafetero. the rental day is considered 24 hours with a tolerance of 59 minutes (subject to the closing hours of the establishment, the lessee declares to be aware). after this tolerance period, an additional rental day will be charged, since fractions and intermediate terms are considered as a full day. the return of the motorcycle must take place during the opening business hours of the lessor motorental col eje cafetero and in the hands of a person in charge authorized by the lessor. the lessee will be required to leave a value of 500.000 cop, as a fee, this value will be returned at the time of returning the motorcycle to the lessee if the motorcycle is in the same conditions as it was delivered otherwise any damage caused to the motorcycle and / or traffic infraction will be deducted from this fee. failure to return the motorcycle at the date and time agreed upon in this contract will result in the lessee's illegal possession declaring the motorcycle stolen, and also obligates the lessee to pay a penalty for each day or part of a day, equal to the rental amount, which increases each day by 15%. elarrendador motorental col eje cafetero reserves the right to terminate the contract and recover the motorcycle at any time in case of violation of the agreed conditions of use, without allowing any claim from the lessee for damages, or any other values and/or reason. in any case, the lessee is obliged to return the motorcycle as soon as the lessor motorental col eje cafetero, demands it verbally or in writing. any property left on the motorcycle upon delivery to the lessor motorental col eje cafetero is considered abandoned, and the lessor motorental col eje cafetero has no obligation to keep them and return them.

8. LIABILITY FOR LESSEE

the lessee undertakes to return the motorcycle, documents and equipment in the same conditions of delivery, and therefore undertakes to restore and pay for all damages caused, except normal wear and tear. in particular, the lessee assumes the obligation to repair. damage caused by placing a different fuel than that provided to the motorcycle for damage resulting from repairs made directly by the lessee by consent.

SANCTIONS

10. FUEL

the lessee shall return the motorcycle in the same way it was delivered. if the lessee delivers the motorcycle dirty, the lessor shall charge a fixed cost of 10.000 cop (ten thousand colombian pesos) if the lessee decides to clean it by himself, the lessor shall check that the motorcycle is in the same conditions as it was delivered.

fuel is not included in the rental price. the lessor, motorental col eje cafetero, will deliver the motorcycle with a full tank of fuel. likewise, the lessee will return the motorcycle in the same manner. if the lessee delivers the motorcycle with less fuel, the lessor will charge a fixed cost of $50.000 cop. if the motorcycle needs oil during its use, it will be assumed immediately by the lessee. this value will be reviewed by the lessor and will be verified.

if the lessee does not return the keys, property card, mechanical technician, soat of the motorcycle, also if they are lost or stolen, will result in a fine of 200 cop (two hundred thousand colombian pesos) each.

12. CONTRACTUAL MODIFICATIONS

any modification of said agreement cannot take place, nor can it be proven, except by written action referred by both parties.

13. CHOICE OF HOME FOR THE PURPOSES OF THIS AGREEMENT

the lessee declares and certifies under his/her own responsibility that the address indicated in the documentation delivered is correct, and that for the purpose of this contract any communication and/or notification will be served at that address, unless it is modified as notified in writing by the lessee directly to the lessor motorental col eje cafetero.

14. RENTAL AND APPLICABLE JURISDICTION

the lessee agrees to rent the selected motorcycle and declares whatever his nationality and language to have read and understood the present contract, agreeing that in order to resolve any doubt or disagreement that may arise from the interpretation and fulfillment of the same, both parties expressly waive their own arguments and agree to assume responsibility for each point set forth in this contract as adults of 18 years of age and in their five senses.

15. OBLIGATION

any person who signs this contract in the name and on behalf of another person and/or company, is personally and integrally liable with his/her own representative for the obligations assumed towards the lessor motorental col eje cafetero.

16. RESERVATION, CANCELLATION AND REFUND POLICY

the refund of the confirmed rental charges is only possible if the request is presented 72 hours before the date on which the motorcycle has been reserved, as long as it is for officially justified or documented reasons.

Note: if due to circumstances beyond the lessee's control, he/she is unable to comply with the established date, he/she may request the reassignment of the date of his/her reservation without any additional charge from the lessor, subject always to the availability of the reserved motorcycle.

motorental col eje cafetero establishes the following for the reimbursement of the reservation expenses:

the lessee must make his request in writing with the reasons for which he wishes to cancel his reservation, attaching the official documents that can support his request, directly to the branch where he made his reservation.

70% of the rental value will be refunded out of the all risk insurance policy taken as an extra at the time of booking.

the 30% discounted goes directly to the management fees and commission for the service provider made your payment. the deposit will have a maximum of withdrawal by the customer of 60 days after this period may no longer be required.
